TERMS AND CONDITIONS FOR HOLIDAYMAKERS

Within these conditions, the following terms have the following meanings:

Agent:- Any person or Company advertising their properties/services with the Business
The Business:- simplyspainandbeyond.com
Holiday:- A holiday booked by you, with the Agent, at the property(s) of an Agent
Website:- www.simplyspainandbeyond.com
You:- The holidaymaker

1. General
1. These conditions govern your use of The Businesses service/website and by using our service/website you have accepted these conditions. The conditions may be amended at any time without notice to you.
2. Any dispute arising in relation to your use of our service will be governed by English law and will be subject to the exclusive jurisdiction of the English Courts.
   
2. Warranties and Liability
1. To the fullest extent permitted by law any and all warranties relating to your use of the Website or our services are excluded.
2. Should you place a booking with an Agent, that contract is between you and the Agent. The Business will not be liable for any losses, whether direct or indirect, suffered by you in relation to any such booking or the cancellation of any such booking, or in relation to anything occurring during a Holiday including all outbound and inbound travelling.
3. The Website or our services may contain advice relating to passports and visas, insurance, health requirements and other matters relating to your Holiday. That advice is not to be relied upon as a statement or representation of fact and the Business will not be liable for any losses suffered by you in relation to that advice.
4. The Business cannot accept responsibility for the content of, nor for the services or goods provided by any organisation in respect of which a link appears on the Website, and will not be liable for any losses suffered by you as a result of following a link or entering into a contract with any such organisation.
   
3. Indemnities
1. You agree to indemnify the Business in respect of all liability, loss, damage and costs incurred as a result of:
1. your use of the Website and/or our services
2. the placing and / or cancellation of a booking with an Agent
3. anything that occurs during your Holiday.
   
4. Content of advertisements
1. All advertisements are submitted by the Agent/the Business and the Business accepts no responsibility for the content or accuracy of advertisements.
2. Nothing contained with the Website/correspondence/e-brochures is to be construed as a representation as to the existence or availability of any property advertised, nor as to the quality or nature of any property advertised.
   
5. Your use of the Website and e-brochures
1. Copyright in the Website and e-brochures vests in The Business. You may not copy the Website or any part of it for any purpose without the express written permission of The Business.
